License Agreement

INTRODUCTION

Please read this document carefully. This is a legal agreement between you (either an individual or an entity) and PGCSoft, the developer of CRM-Express and CRM-Express (the SOFTWARE). This Agreement supersedes any prior version license and governs your use of the SOFTWARE. Do not install the SOFTWARE or remove the SOFTWARE together with all copies of it from your computer if you disagree with any of the terms in this agreement.

The trial download of CRM-Express is fully functional for 30 days and is provided to evaluate the application’s functionality, capabilities and suitability to task. It expires after 30 days of use.

On registration and on receipt of the machine identification number from you, PGCSoft will send you an unlock (activation) code by e-mail that will convert it to the licensed product. The licensed product will only work on the machine on which it was licensed for. The activated or unlocked software DOES NOT expire. Replacement activation codes will be provided to the licensed owner in case of a hard disk crash, moving to another machine, etc.

INDEMNIFICATION

By installing and using the SOFTWARE on your computer, you agree to save and hold harmless PGCSoft from any loss, direct or consequential damage, or claim incurred by you resulting from reliance upon the results obtained through the use of the SOFTWARE.

GRANT OF LICENSE

This license gives you certain limited rights to use the SOFTWARE . PGCSoft Software products are not sold but licensed for use. You do not become an owner of and PGCSoft retains title to all the SOFTWARE,  SOFTWARE Copies and Related Materials. PGCSoft grants you the right to use this SOFTWARE as follows:

1. You may not lend, give, rent, lease, sub-license and transfer the licensed SOFTWARE and related materials to other parties without the permission of PGCSoft.
2. You may not alter, disassemble, de-compile, reverse engineer, duplicate or create a derivative work with the same "look and feel" or otherwise use the SOFTWARE except as stated in this License agreement.
3. This SOFTWARE must only be used under the conditions and on operating systems for which the SOFTWARE was designed.
4. You need a license for every machine that the program is installed on.
5. The licenses of users are automatically revoked without the option of a refund if they do not adhere to the License Agreement and may also be prosecuted.

COPYRIGHT

The SOFTWARE and Trademark are owned by PGCSoft and is protected by International copyright laws and treaty provisions.

SOFTWARE SUPPORT AND UPDATES

Support will only be provided by E-MAIL to licensed users and only on the most current version of the SOFTWARE. Queries regarding the installation and use of the SOFTWARE, as well as requests for additional features and enhancements, should be submitted through the helpdesk or the support form available at:

PGCSoft will attempt to implement all reasonable modification requests but is not obliged to do so. Minor version updates of the product are free within one year of original purchase. Major version updates are free that are released within 90 days of your original purchase. PGCSoft cannot guarantee software updates.

LIMITED WARRANTY/LIMITATION OF LIABILITY

This SOFTWARE is licensed AS IS. It is your responsibility to ensure that the product works on your particular system configuration and for your particular needs. These warranties are in lieu of any other warranties, expressed or implied, including the implied warranties of merchantability and fitness for a particular purpose. In no event will PGCSoft be liable to you for damages, including any loss of profits, lost savings, or other incidental or consequential damages arising out of your use of or inability to use the SOFTWARE, even if PGCSoft has been advised of the possibility of such damages. ANY LIABILITY WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE MINUS ADMINISTRATION FEES. The ADMINISTRATION FEES are 10 percent of the purchase price.

RESERVATION

PGCSoft reserves the right to change the license agreement of the software. PGCSoft reserves the right to change the product as it sees fit. PGCSoft reserves the right to change prices without notice.
